View Full Version : Buying and selling a home during ch. 13 BANKRUPTCY

Me and my husband are ch. 13 for a little over a year. We have spoken to someone about selling our home and buying a new one. They told us that they had people that do home loans and that it shouldn't be a problem . My question is what kind of interest rate would we have and could we get a va loan? They also told us that we could convert it to a ch. 7 after 2 years. And if we got enough for our home to pay it off and also the truck off the our ch.13 payment would go down a lot, and then we could convert next march and we would be clear of bankruptcy, is this true?

Welcome to AMHD. You are covering a lot of legal territory. Do you have an attorney? It is evident that you are wanting to change course, at least somewhat, after having filed a Chapter 13. Apparently, your case has been confirmed and is being funded. Let me quote you: "we have spoken to someone about selling our home and buying a new one. they told us that they had people that do home loans and that it shouldn't be a problem". That is incorrect. I would ask you to consult your attorney and possibly the Chapter 13 Trustee's office for clarification.

As long as you have permission from the trustee from bankruptcy court to both sell the property and buy another one. There would have to be low equity in the home being sold or all money past the allowed limits would go to the court to pay bills.

As for as interest rates, if they find someone to do it, I would guess very extremely high
