I have an item on my credit report that is not mine. I have spoken to two representatives from the creditor who agree it is not my debt because the date of birth on the files shows a person that is 75 years of age... I am 48 years old. I disputed this item with the three major credit bureaus and it has been removed by Equifax. However, TransUnion and Experian both show the item was disputed and resolved with the item still showing on my credit reports... Is there some legal avenue I can take to resolve this? I am sure the creditor reps that I spoke with are just customer service reps with no authority to remove the item from my credit bureau reports. Any help or advice would be appreciated.

Check this: "Q: What can I do if the consumer reporting company or information provider won't correct the information I dispute?
A: If an investigation doesn't resolve your dispute with the consumer reporting company, you can ask that a statement of the dispute be included in your file and in future reports. You also can ask the consumer reporting company to provide your state­ment to anyone who received a copy of your report in the recent past. You can expect to pay a fee for this service.

"If you tell the information provider that you dispute an item, a notice of your dispute must be included any time the information provider reports the item to a consumer reporting company."
