My boyfriend violated his probation.( he was on misdeamonor probation for DUI). He failed a drug test, didn't complete his courese on time, and didn't do his community service hours. His probation officer put a warrant out for his areest so he was picked by the sherriff's on Feb. 19th. Well, today is March 20th and I am just curious on whether or not he will be getting out on Monday March 24th. I was also curious on how long he will be in for if he doesn't get out on that day. Thank you!

Hello I:

Well, I don't know what's so special about that day. The po can keep him in jail until he has a violation hearing. I don't think they're in any hurry to schedule that either.

He is in, till he goes before the judge for a hearing, and then the judge may send him to jail for longer.

As soon as he has his probation violation hearing and the judge decides what his jail time is going to be - then you can look for him to go home at a much later date. My guess would be that the judge is going to reinstate his original sentence which probably included jail time and sentence him to more jail time as he failed a drug test, didn't complete his probation requirements and community service obligations the judge had originally ordered. Judges don't take kindly to people defying their orders.
