Hi,

I'm a residence in California. I just filled application for ITIN for my dependents together with my 1040 tax return and send it to Austin ITIN office in Texas on March 16, 2008 . Then I called the ITIN office and ask how long it will take for them to give ITIN for my dependents and they said it will take 10 weeks. My question is will I be late for the deadline on April 15 for the filling of federal tax? Are they going to automatically process my returns after they assigned ITIN or are they going to send it back to me and then do the filling. And how can I claim exception on state tax if I still have no ITIN for my dependents. Is California have the same deadline on April 15 for the state tax.

If you have not received your ITIN yet, be patient, as the ITIN processing center undergoes is largest volume in March and April.

You can file the California return WITHOUT your wife's and children's ITINs. California will merely ask that you inform them of the ITINs when you receive them.
