Thanks all for you help regarding to Federal and State taxes.

I have an SSN, but my spouse has a ITIN. Can we both get a payment Stimulated Tax Payment?
If not then am I eligible to get Stimulus Payments.
We already filed a taxes as married filing jointly.

You are not eligible to receive the stimulus payment. If you file as Married Filing Jointly then both you and your spouse must have an SS number to qualify - if one of you has an ITIN then neither of you will receive the payment.

Here's information from the IRS that spells this out:

Sad News.

If my wife gets SSN in 2008 as she applied for H1 Visa, will her SSN from 2008, will amend our 2007 tax return to get Stimulus Payments for Married filing Jointly for 2007 returns?
Any suggestions / comments.

Thanks for reply ebaines.
