I Got Into A Argument With A Store Clerk Over Beer I Drove Off With The Beer I Had She Said I Stole It She Called The Cops The Amount Of The Beer Was 1.19 The Is My Second Conviction For Theft In The Third Degree Will I Go To Jail .

I would think so on a second offense I personaly would get a laywer and take it from there. Is the store clerk the one pressing the charges or the state? Just curious cause if it's the clerk you might be able to pay her something and ask for her to drop the charges. I think it is worth a shot. Sorry!

Please take a moment and introduce yourself in the introduction area.

Let me see you refused to pay a clerk and argued about it, and drove off.
Yes that is theft, and I would guess a few days in jail to teach you a lesson, probatoin. Now if you are still on probation for the first theft, it is very possible you will see a lot more jail time

I don't think you're allowed to pay off the complaining party (tongue in cheek) - not in any State I know. And, of course, the clerk isn't the "Plaintiff" - the People of the State are pressing the charges. It's The People vs OP so you are suggesting he buy off a witness - ?

And, yes, if you drive off with something without paying for it it's stealing.

Yes, this is considered theft on your part whether you argued with the clerk or not she called the police and made a report on the $1.19. It doesn't matter if it was a 25 cent pack of gum - shoplifting is stealing and you stole the beer. This is going to be the most expensive bottle of beer you ever purchased once all is said and done and your judge sentences you. Would suggest you hire a good attorney to defend you asap on this.
