View Full Version : 1040 nr, 1040 nr-ez or 1040 ez ?

Im on L1B and my wife is on F1.
This is the first time that Im going to file my tax but it's the second time for my wife (she used 1040 nr for her last year tax filing).

Appreciate your thoughts on the followings

1) What is the form that I need to use, is it 1040 nr, 1040 nr-ez or 1040 ez ?
2) Is it possible for us to file tax together ? If so which form that we need to use ?
3) Can we use Turbotax or any other website to file our tax ?

Jil:

You can file jointly with your wife and you both CHOSE to be treated as resident aliens. This will allow you to claim the $10,700 joint standard deduction plus two $3,400 personal exemption (for yourself and your wife).

The downside is that:

• you must WAIT to meet the Substantial Test before you can file, which may delay your filing.

• you must declare ALL 2007 world-wide income. There are two offsets available, by either claiming a Foreign Tax Credit (Form 1116) or a Foreign Income Exclusion (Form 2555).

Even with the downside, this is probably the best way for you to file.
