Situation: Yearly Homeowner Due of $300.00 due by January 5, payment not received by 5th, homeowner charged late fee and finance charge, payment of $300.00 received by 10th, leaving payment due of $27.50 for late fee and finance charge, which would be due by February 5, payment not received, another late fee and finance charge charged.

Question: Is it lawful to charge a late fee and finance charge on an uppaid late fee and finance charge? One attorney asked said it was within there right to do so...

I don't know if you have the right to screw this guy like you want to. You probably don't. I hope he takes you to court.

For FIVE days, you want all this money?? Don't you have anything better to do, like sweep a sidewalk??

You are exactly the reason why I hate HOA's.

Its not me doing the screwing, it's the President of the HOA... I don't believe its right to charge a late fee for an unpaid late fee or a finance charge for an unpaid late fee or finance charge.

I'm fighting with them right now because they won't allow me to put up a basketball hoop, but not where does it say I CANNOT!! They just don't like the idea.

Please get the facts straight before you ASSUME anything!

I also hate homowners associations. Went to a meeting last night.. got mad as "___" and walked out! I sympathize with you, but you might as well pay it because they have the power to do it.
Took us a year to get a driveway approved and my husband has his construction company do it professionally. I wanted to plant a Silver Willow in my front yard, but I was told it would grow too tall and that I could not plant it.

If you get 60% of the homeowner's in the subdivision to vote out the Homeowner's Association you can vote it out. You can also apply to be on the board and have a say in the regulations although our board is two people and only one showed up at the annual meeting. We were told we had to have a majority to vote them out, but they can make rules like raising our fees without a majority. What a crock!

Sorry I am not helping, I think that the Homeowner's Associations are just all a bunch of rotten crooks!

Late fees are added to the balance owed. If a balance remains unpaid its subject to additional late fees. Nothing illegal about that. The homeowner knew the bill was due and that latefees accrued.
