Hello --

I believe that I should file as a dual-status but want to make sure.

I am a Canadian citizen.

I moved to the US in September 2001 to study on an F1 visa. I graduated in May 2005 and used my F1 to work in the US until April 2006. From April 2006 to October 2006 I was on an TN visa. From October 2006 to July 2007 I was on an H1B visa.

At the end of July 2007 I moved from the US back to Canada. I worked in Canada from August 2007 through the end of the year (I will remain in Canada for the foreseeable future).

I believe that I should file as a Dual-Status and use form 1040NR because I was a resident at the beginning of the year but a non-resident at the end of the year. Not sure what to do about the Canadian taxes.

I was single throughout the whole time and don't have any property.

Any guidance would be appreciated!

You are correct; you must file as a dual-status alien.
