My ex-wife has kept my son from me for three years. During this time they have built another family and my son has no desire to see me. Its as crazy as see has papers saying she will be present for my first four months of visitation to ensure a reestablished bond. I am now paying over eight hundred dollars for a child who I feel is no longer mine and I wish to terminate my parental rights. I would like the proper information to do this. I live in CO and they are in Chicago. Someone please walk me through this.:confused:

If she has built a new family, does that mean she has remarried? If so, then you need to get her new husband to adopt. That's the only way you will get out of paying support. There are many threads in the Family Law forum that discuss this issue.

Generally a Termination of Parental Rights (TPR) is granted only when there is someone waiting to adopt or the parent represents a danger to the child. Its never granted just to allow the parent to get out of child support.

What you should have been doing all this time is fighting to enforce your visitation rights.

I am sorry for three years you decided not to fight for the right to see your child, you could have and should have taken her to court to find her in contempt of the court ordered visits.

So while she may have said no, you could have taken her back anytime.

So you allowed her to keep the child from you. I know I would have been in jail before my ex could have keep my child from me.

But no unless she wants a new partner to adopt, you are not going to get out of your child support.

If she is remarried and her new spouse is willing to adopt the child, you can relinquish your rights to allow for the adoption. Other than that, you can't relinquish your parental rights and obligations.
