As per my university instructions I used cintax to prepare my federal taxes. I came to USA in 2005 on an F2 visa(dependent to my wife) but went back in January 2006 to INDIA and got F1 visa stamped and started studying Masters in the same university as my wife. I earned around 11000 dollars as a graduate assistant but when I filled out the cintax form it says that I am not eligible for any treaty benefits and thus did not apply any standard deduction. I know that as an Indian I am exempt for 5350 dollars and 3000 dollars personal exemption. When I went to my university tax person she said that because I entered the USA on F2 first I should have stayed in INDIA for an year before I come back as an F1. I think this is faulty!! OR IS THIS TRUE?? Please Help me!!

Actually, your personal exemption for 2007 is $3,400.

Your F-1 visa is valid; there is no waiting period required that I know of.

File Form 1040NR-EZ and claim the standard deduction.
