How about Taxes.

I've heard a person on full disability cannot claim their kids (dependents) on taxes, b-cause they don't pay taxes on the this. Benefit. Does this permit me to claim Jr. even though he did not live w/me, at all, in 2007? He lived with his mom (my ex).



Seems like that tax break, goes to waste, if neither of us can claim?

In most cases that I have heard of the tax write off is a stipulation of your custody / child support arrangement. You can ask your ex to stipulate that you deduct the kids from your taxes and its legal but please get the courts stamp of approval on it. She may want a share and to you. But check your court papers carefully and see what it says first before proceeding. If you don't understand in any way what they say seek a lawyer and if your seeking court approval you may want to get one anyway.
