I'm a 25 y/o female that was arrested December 11st 2007, for Theft by Deception (4th degree) by my former employer. I obtained about 6k, and I paid back most of it before my first court date (January 23rd, 2008). I only owe about 1350 and I met with my Probation Officer on 1/23/08 (the same day as my court hearing). I have a sentence of 1 year, and my 2nd probation visit is coming up (2/26/08). I was accepted into Pre Trial Intervention in Union County NJ as well. My questions are:
I am a frequent pot smoker (I have been smoking since I was 17 on a daily basis), but I have not smoked since 1/22/08. I'm not sure if my body will be able to cleanse itself by 2/26/08, and I am very nervous because I have "random urine monitoring". I do plan to buy an "at home" marijuana test from a local drug store, and if I fail.. I will have to turn to my 13 year old sister for her urine (my last resort). Anyway, I just wanted to know what would happen if I fail my drug test and get kicked out of probation? I know I would go back to the formal court process, but would I face jail time?
Also, does anyone know about the "Initial Home Visit"? Is this something that is random or scheduled. I ask this because between the time I was arrested and my first court appearance, I lost my apartment and had to move into my boyfriend's parents house which is in a different county. My probation officer said they would have to transfer me to that county, and they would have to do the initial home visit to my b/f's parents house (which they don't even know I got arrested - so I can't let them do the home visit there). So I ended up giving them my parent's address in Union County, but I don't really sleep there at night, but my license and mail goes to that address (as of now).
My probation officer seems like a real hard-butt (get it? Lol), and she's not nice at all. Me, I am a timid and shy person that just made a horrible mistake due to facing homelessness at the time. I'm not trying to justify what I did, but I just want to let you understand how I act when I see her. I am not giving her attitude or anything and I am very cooperative.
Maybe someone with a little insight on this could help me and make me more familiar with what I have to expect.
Also, I was told by the judge if I do:
My 60 hours of community Service
Maintain Full Time Employment
Pay my restitution
and basically do everything right (according to probation standards), I could be let off early.
So if I try to knock off my community service, and pay back the $1300 or so within 3 to 4 months (which I can do), is that too early for them to let me off?
I know I have randomness and questions everywhere on my post. :-)
