Hi,

I am residing in US on H1B for last 3 years.I got married in July 2007 in India and my spouse came along with me on H-4 Visa in July 2007 as well.I changed my marital status as "married" on the Employers Corporate WebSite. But did not change the W-4 information separately

Now I received my 2007 W-2 and it says my taxable marital status as "Single".

My question is that if I file my 2007 tax return as "Married filing jointly" will it create any issue ?

Did anyone encounter similar situation or know how I can fix my 2007 W-2 now ?

I appreciate any help in advance

Your marital status on Forms W-4 and W-2 relate to how much tax should be withheld from your pay and have nothing to do with the final amount of tax you owe. Don't worry about it. You should notify your employer of the change in status so that you have the correct amount withheld in 2008, but don't worry about 2007.

Yes you can file as Married Filing Jointly (as residents) for 2007. You must declare your wife's worldwide income for 2007. She needs ITIN so you will file form W7
