Can my boyfriend claim my son on his taxes. He mainly contributes to our household and I don't make that much money. Is he able to claim my son who is not his biological child, and our biological son on his taxes. Thanks Jill

Does he live with you and SUPPORT the household (pays the rent, buys groceries, etc.)?
How MUCH do you make?

Yes he lives with us, and is the main source of income. His income was around 28000, and mine was around 12000. I used the hrblock tax calculator to find out if he did or didn't, and it went from him just claiming our second, for 2300 to him claiming both of the kids, and it jumped to almost 6000. It doesn't ask any major questions, but just gives you an estimate. I didn't know if we had to be married, or if because he is the one that mainly supports ll of us, he could claim a non biological child. Thanks Jill

Your boyfriend can't claim you as your earned more than $3,400. He can't claim your son because he is your Qualifying Child. Only you can claim your son.

Agreed: you MUST claim he children.
