Hi,

I recently sublet a room in a house I rent to a person in October of 2007. There are many issues starting to surface that may result in me asking him to leave. He is not on the main lease to the house, it is just me. I had him sign a month to month lease where he pays me rent at the first of the month. I in turn pay the landlord out of my bank account. If it turns out it doesn't work out with him and I want him to leave are there any legal issues that he could bring up or any legal means he would have to stay? Can I give him 30 days notice and be done with it? Any information is greatly appreciated.

Yes, since he's on a month to month, you should give him notice equal to one rental period. However, if he refuses to leave, you will have to go through an eviction process. You are his landlord and he your tenant so YOUR landlord has no involvement.

Thank you for the response. I wanted to make sure I could ask him to leave and give him 30 days notice and I would not be in violation of some unknown law. Cheers!
