Are you describing your debt, your husband's debt, or a joint (both of you) debt?

My guess is, your husband's debt is his, and your debt is yours, even in California. In other words, his debts do not appear on your credit report, or vice versa. A case is started when it is filed in a court. At some point, for the case to go forward, you have to be served, usually service is 'personal', and a copy is handed to you. In many instances, the copy of the complaint does not have a court date; it does specify that you must file an answer within so many days (could be 20, 30, 35, whatever the law allows). If you don't answer, the plaintiff can request a default judgement, usually for everything it has asked for in the complaint (principal, interest, attorney fees, and costs). A garnishment/levy may follow after the judgement is entered.
