I would get the refund first; as you use the money, keep a record of where it is spent. Then file your petition, unless you are in an emergency. If you need to file first, make certain your attorney lists your tax refund as 'exempt property'.

By refund do you mean your tax refund? You would still get it unless part of what you owe is to the IRS.

Actully in most bankrutpcy, if you have one due during the time that you are due they court may take it and apply it to your debts.
You would have to file for it as an exemption if that amount falls under the allowed exemption of cash on hand.
