I stumbled upon some marijuana in my roommate's room when I put a sweatshirt on her bed. My boyfriend said that last week, while I was sick and too stuffed up to smell anything, he had smelled pot all over the apartment. I figured that I would wait for something else to happen, until I could smell the evidence. It didn't take long. The day after, yesterday, I got home from work late, and she obviously assumed that I wasn't coming home. She was locked up in her room, and when she heard me, I heard her open her door and shut it quickly. When I walked by a few minutes later, it very obviously smelled like marijuana. I'm very much against drugs, and she was too when we moved in so it was never discussed what would happen if anything like this occurred. We have four months left on our lease and I'm not about to put up with this anymore. However, I'm not really sure what I'm legally allowed to do. Can I (1) ask her to leave but continue to pay rent? (2) Ask her to move out AND pay the break lease fee of $1270? (3) or can I move out and stick her with the remainder of the rent for the duration of the lease?

I think a good sloution would be to ask her not to smoke it in the apartment. If you have managed to live with her for 8 months and this is her only vice.. I would try that first.
