My friend is being sued for marital infidelity. Of which there is no photo proof. The land the home was built on was purchased from his father from a larger block of "family" land. He then spent an entire year building it. He put in half of the money(gained before the marriage), but his wife works and is for the most part the bread winner.
It can be shown the marriage was a bust long ago. Marriage councilors and such. There are no children.
Who is likely to get the house? What steps can he take to help his cause.
Thank you.

It would depend on what the state laws are. Do you live in a no fault state? In Ohio, half of everything my husband has is mine. It doesn't matter if any of it was his before we married.
So, it would depend on something like that. Your friend may be able to keep the house and then buy her part out.

Verty likely they will have to split the value. But with divorce court it is so hard to tell

Her assets may also come into the equation, such as any retirement accounts etc that could be used to offset the value of the home, what about palimony?
