Support and visitation are not tied together. You can get support and have vistation denied. But if he decides to go after visitation, unless he presents a danger to the child, he will probably get it. However, if he has said he doesn't want to do it, he may threaten to get you to back off on the support, but won't foillow through.

Well if he is the legal father (signed the birth certificate, DNA test etc), then he already has rights to her... just a matter of if he exercises his rights.

He can go to the courts for visitation orders whenever he wants. Unless you can prove he is a danger to the child, he will get visitation... nothing you can really do about it, after all, it's his child too.

Child support and visitation are 2 separate issues, sometimes they are heard together at the same hearing, but they are not tied together. Once there is a court order for visitation and child support, they must be followed. You cannot refuse to let him see the child just because he may not pay child support, and he can't stop paying child support if he isn't seeing the child. They don't work that way. Child support is for the financial well being of the child, it has nothing to do with the parent-child relationship.

But just be prepared... if you go after him for child support, be ready to go to court for visitation, because I'm sure he will file for it.

So he is not on the birth certificate. Well as of right now he has no legal rights to the child. But on the same token, you can't go after him for child support without proving he is the father.

When you go to file for child support, since he is not on the birth certificate, they will order a DNA test to be done. Once that is done, and if it proves him to be the father, then you will be able to get child support from him.

AND

He will be able to take the results from the DNA test and file for visitation, and/or his name to be added to the birth certificate.
