Hi,

I have a valid H1b till Jul2010 from my current employer A and I have not been to US till now. I wish to switch my job to employer B and work for employer B in US. Is this legally possible? I mean without travelling even once to US, can I transfer my H1B to a new employer? If no, what are the conditions to transfer my H1B, please let me know.

I'm not a lawyer, here is my 2 cents, use it on your own RISK

Your H1 cannot be transferred to another employer unless you are in USA. If you have found employer B willing to transfer your H1, and if your H1 is still valid (not closed by your employer A) you could still travel to USA and then have the employer B transferring your H1. However this is RISKY. Please talk to an immigration lawyer first

Your new employer can file for NEW H1 Petition (this is different from H1 Transfer or change of employer petition). Premium processing will fetch the approval in 15 days and you can use your old visa on your passport from previous employer but show the new I797 filed by your new employer at the port of entry.

Hi
I worked for Emp A in india and resigned after a month of receiving h1b.Since there is no onsite opportunities in that project and didn't received promotion.I got offer in emp B and joined .question is can I transfer h1b to emp B.I handed over petition to emp A in separation process. But having the copy of it.Visa is valid for 2 yrs/



Can I transfer h1b to emp B?
