If I put a name on the birth certificate when he is not the bio father but will be the baby's guardian is that illegal ? Considered fraud ? I'm not even sure if that's what I would do but I'm just wondering what are the laws against that ? Can I give my son a different last name than mine if there is no "father" on the birth certificate ?I hope these questions don't make me look ignorant... :o

Of course it is illegal, the bio father goes on the birth certificate only. Yes it is fraud, you are attempting to cheat or take away the rights of the real father. Now you can leave it blank, there is no requirement to put a fathers name at all. You can name the child what you would like,

If you want yourr husband ( to adopt the child,) get the bio father to sign over his rights, to allow this other man to adopt

Does not make you look ignorant at all, makes you look like you are trying to pass something off that is not true. Leave the space blank where it says father if you must. Just do not try to pass someone off as the birth father when it is not true.

Thanks guys ! I knew that was the case but what I'm asking is if the father is blank , but I want to give my son a last name other than mine... is that illegal ?
