I'm not married and the father of my child is in jail and his mother is taking me to court for custody rights I don't want her to have any until the father gets out of jail do I have a leg to stand on?

You are the mother and the child's grandmother is suing for custody? Unless she can prove you are unfit, that is unlikely to happen.

Grandmother would have to prove you unfit to properly care for the child in order to get custody... which is very unlikely to happen.
