Hi,
How do you know if your felony can be expunged? I was sentenced 1 yr probation and my p.o. told me when I am done this June that it can be expunged/ Could this be true? First time offender, non violent, and everything was recovered ($750.00), and judge was very kind in saying that I should not have gotten a record?

Yes, but you have to go before a judge with this request. How this is exactly done, I'm unsure, but you can get this done... are you under 18?

No, I'm 29 horrible I know. I was just so stupid. Anyway probaton is up this June and my po really wants to get the probation terminated early since she feels that I alrealy fulfilled all my requirements.

From my understanding, getting a record expunged is for only those eighteen and under, but I could be wrong on that. I would think that if you had a sincere dialog with the judge that you are truly sorry for what you've done, that you've changed your ways, then there may be a way to have that crime expunged.
See what your po thinks of my perspective, as I am no lawyer myself, but I'd think a sincere effort could give you at least a chance to have the judge rule in favor of your penitent effort.

Hi again,
The first day of my probation the p.o. said to me that I should have been given a diversion and then handed me a expungement form and told me that my crime can be expunged but I have to get through probation first. Also on the day of sentencing the judge told my lawyer and the prosecuter that he was unhappy with what they decided and they should have worked it out better (out loud in the court room). He said he didn't understand why I had to suffer the stigma of a record. So he waived all probation fees,and no restution. Who knows though, I'm no lawyer myself, but I am truly sorry.
