My son's ex girlfiend took his daughter to another state where her mother lives. My son lives in Oregon and they now live in Iowa. Originally, his ex did not know how long they were going to be there and now they have been there 2 years. My son has not seen his daughter in all this time. Of course, she filed for child support.

My son has done everything in his power to either get back with her or to try and see the child. They have been communicating back in forth via e-mail and phone and now she has changed her phone number and won't reply to any of his e-mails. Now we don't even get to see photos of his daughter.:(

He is really upset about all of this and does not know what to do. He does not have any money for a lawyer.

Does he have any rights?

Obviously your son has not done everything he can, if he hasn't gotten a lawyer.

He should have filed for joint custody with visitation as soon as the daughter was born. Had he done so, she wold have needed his permission to move. He NEEDS an attorney to file.

My son and his ex were together until the baby was about 5 months old. My son did not realize that this was going to happen when they left for Iowa.

He is looking into getting help through Legal Aid.

Since there is no visitation order set as of now, she can move wherever she likes. As Scott said, had there been an order, she would have needed his permission to move states with the child.

He needs to jump on this now, while he knows where the mother and child are at.
