Hello, my employer was given a wage garnishment for a judgment that is 8 years old. I check the court file and the creditor's lawyers haven't renew the judgement. I also just found out the company that I received the credit from has been out of business for the last 3 years. Can the lawyers still collect on an old judgement that is not renew? And if the company has been out of business? What motions can I file?

Also, when I went to courthouse to get check my file they said that I have a court apperence on Nov 7. I was never given a notice about this court appearance? I however notice on the wage assignment that was given to me by my employer that they (employer) had to respond by Nov 7. I am totally confuse. If I would have never went to courthouse to check my file - I would have never knew about the court date. Can I discussed during the court (Nov 7) dismissal because of the expired date? Please help.

File Notice of Intent to defend, file Motion to vacate the garnishment writ at the same time and MOtin to vacate the judgment.

Make them prove their claim at the hearing.
