Hello,

I have purchased a Fido Cellphone on August 4th. When I received my second bill, I was charge for an Internet access in the amount of $706.90 dated on August 24th. I have argued with the Customer Service and the Supervisor, telling them, that I have no way of accessing the internet, because I always have it with me and that I don't even know how to use the internet on the cell phone. They said according to their record, the sim card matches the access of the internet. I was disputing of paying for the whole amount because I did not use the internet, and I did not request to have access. My brother had the same problem, he too was charge for $300.00 and had to pay it. Well, I have requested to provide me proof to pull record of which site that was accessed in. They said they can't do that because it is a private violation. I told them that it is not when I am giving them the authority to investigate. They still cannot, with other excuses and so forth. I have also asked them to pull all the internet activity after Sept 18 to present so to see who's using my internet. They said they have no access to pull that info. Until my next bill. Every company has access to everything especially if you want to monitor a fraudulent acts. Am I being scammed by this company? To make the story short they have taken out $175.00 + tax (14%) out of the $706.90 for my satisfactory. But I am not satisfied because according to them I am liable to pay everything even if it wasn't me that used the cellphone. To me this is a bad service, and pointing fingers at the consumer that hey! It's your fault! And we have no mistakes in charging you with this amount because our system is accurate, and yet they can't provide me a single proof? So I have to pay this. Is there a way to claim or even fight this with them in the court? How much will it cost me? Should I cancel my payment? Please advise.

Thanks,
Maricel

You need to contact your local Public service commission. Cell phone are subject to some regulation. They can help you resolve this dispute. But its up to the company to prove the charges are yours.

If your in Quebec contact OPC, when they gave you the credit of 175.00 plus tax did you agree verbally that this was acceptable? I had the same problem with Rogers and they credited it without an argument. Fido tends to use a lot of small third party companies to do their customer service and these people don't have the authority to credit charges. Call back and ask flatout if they work for Fido directly or in a 3rd party call centre. Get them to transfer you to someone from Fido.

Thanks to all the responses.

No, I did not download or sent any emails to anyone. Because I don't even know how to get in to the website through the cell phone. I've asked Fido to pull up the proof and confirm the sites and what ever it was that was downloaded. They said, they don't have the capabilities to pull those details because they are all encrypted. And even if there was, I am still liable to pay. Which is not fair because I did not use the internet service.

When I've spoken to the customer service the supervisor is from Fido, so I assumed that there were no third party involved.
