View Full Version : Is a Sublease valid if Lessors lease is in default?

I am subleasing a commercial property. I gave notice to my lessor that I am moving. MY lease was completed February 2007. She stated that since I did not notify her 60 days before February 2007 that my lease automatically renewed and I would have to pay the lease through February 2008. But, it has come to my attention she is behind on her lease obligations to the building. Can I get out of this lease if she is in default of her lease?

Any answers would be greatly appreciated.

No, her relationship with her landlord has no bearing on you, except to the point, that if her landlord terminates her lease, then yours is also terminated at the same time.

Did you check your lease? Is it written as she says that the lease automatically renews for one year if 60 days notice is not given?
