I don't think I understand what you mean by "illegal parents." Can you elaborate?

You will need to contact a family law attorney in your area.

Why was she awarded custody? Do you mean she just has him physically, or she has been given custody by a judge in cort? If not than neither of you actuly have custody possession is 9/10 of the law (or so they say) I just went through a custody thing with my X over our son. Until someone is given custody legaly no one really has it. Is she the biological mother?

Being an illegal alien does not make one an illegal parent. I'm confused though, if you are a citizen and she was married to you, then why isn't she a citizen?

Also why does she have physical custody? Did you go to court about it?

To get physical custody you would have to go physically take the child "in no way do i condone physical vilonce of harming others"
Legal custody is what you want for that you have to take her to court and that is not what she will want if she is in this country and not supposed to be

Yes, the legal status of the person is often not an issue

I don't know I just worry, I only get to see my son every other weekend for 2 day and that not a enough time. Every time I adjust my concern about her to the mediator they seem to be on her side. She not working, move from one place to other, her living condition is not stable. I don't know where she most of the time. All I know is the time I go pick my son up that it. No information to contract her or anything. No clues, why the court order her phyical custody when her living condition is not stable.

Report this to children's services and go back to court with proof to change the custody order.
