Can one married partner access the bank account of other partner if their name does not appear on the account. If the person who is not an account holder, transfers money from the spouses online account using a password acquired by deceptive means, have they committed a crime?

I'd think that's bank fraud and you should contact the financial istitution. I know I've made deposits into my wife's account and the bank handed me a deposit confirmation, but they made certain they had blacked out the balance. That was frustrating to me because my wife is very ill and my goal was to make sure her automatic deductions would be covered. I don't blame the bank, I blame myself. Truthfully, they shouldn't reveal her balance. They don't know our "status" and if the situation were different, I'd be shocked to find out someone making a deposit into my account could find out my banking situation.

No, one partner can not do anything with the account of the other that they are not a listed owner of. The fact you stated theyused deceptive means to get the account number. I would have to ask how, I have one account my wife is not on, She will not know the password unless you told them. As for as "criminal, it will depend on your specific states law.
