I have a very important qeustion!! I have a younger sister who lives with our legal mother, but she is having an extremely tough time! But does very well with me and my husband. Is it legal for us to take her and be her legal gardians, is there some kind of form we have to fill out would we be able to sign letters saying she could leave the country to go see family etc. if there is some way to do this how would we what steps need to be taken and do we need approval form the birth mother? Sorry for so many qeustions but I can't find any site to solve them and it's very important so please if you can answer any of these qeustion please please pleqase do.

Where do you live? Every place is a little different. Is the "legal mother" the birth mother? Does she say its OK for you to have legal custody of your sister or will she fight you. It is a court matter, even if everything is agreed to you will need a lawyer to draft the papers and file them with the courts.

Maybe instead of you getting custody of your sister you can talk to your mom and get her to agree to you having your sister stay with you for a little while. Then see how things are from there. Best of luck for you and your sister, it's a tough place to be in.

You should consult a family attorney. They can advise you what you need to do. You will need to file a petition in Family court to take over guardianship. Whether the petition will be granted depends on what the other parties say.
