I am charge with a crime for fraud of unemployment insurance. Since this is my first time would they give me a violation? My legal aid is saying that I only have 2 choices is to pay the whole amount back or spend 3 years in probation with a misdemeanor class a . What should I do?

It's a classification for misdemeanors - not a class.

So, you change the question, and say I didn't answer it?? That's not nice. I'll answer your new question, however. You should plead not guilty and ask for a jury trial.

Of course they will charge you if you don't pay it back, then put you on probation and force you to pay a fine, plus pay monthly payments to pay back everything.

Sounds like your legal aid thinks they have an very good case against you. If you think you can prove innocence, ask for a jury trial. If you think you will be found guilty pay restitution.
