What is the legal age when children decide which parent they want to stay. I live in Atlanta, Georgia (Clayton County).

I am sorry, a child can never just decide when and where they are going to live. At 10 to 12 most courts will allow the child to speak in court and tell the judge where they want to live. But the court will always still look at other evidence such as parents home life and safety of the child.

So the parent who does not have custody will have to file in court for custody, the child will testify, both parties will present evidence.

A child can never just decide and move where they want to live without court approval.

True, as the court is supposed to be for the best interest of the child. And yes, the court will deliver an 'enima' to both parents of the home-life for the child, but there is an age that a child can make a strong appeal that is more credible to persuade the court.
