I have sreviced a summons for a credit card debt and I would like to respond with a motion to discoer.. how do I do that and would it prolong the case?

I am not an attorney, can't tell you exactly how to properly file a motion for discovery, but it would probably give you a few more days, or a month or so, maybe. All they would need to do would be to produce a copy of your signed agreement and perhaps the record of purchases. Might be a good idea to have an attorney reprresent you.

You first need to file your Intention to defend. Once that is accepted you will be assigned a court date. Then you can send the creditor a letter requesting documentation of the debt.
