View Full Version : Is it ILLEGAL to get a payday loan by submitting my husband's checking account info?

PLEASE HELP!!!!!!!!!!

I really need to know the answer to this... My husband and I have an appointment with a lawyer on Tuesday to file for a divorce. He already has his half of the money, but I do not.
I am a substitute teacher, so therefore I do not work in the summer time. I will, however, have a small college check that will be coming in August. Here is my question: I have looked online and checked into getting one of those payday loans for $500. This would take care of my half of the divorce money. Is it illegal for me to submit the loan using his checking account information? I am not on the account, he took me off over a year ago. While we have been married, I was only allowed to have the money that he would let me have. I do not see any other options as to how I can come up with this money by Tuesday. No one in my family is able to help. So is it illegal to do this? Could I get in trouble if I do? What could the law do to me? We are still legally married. Please, please , please if anyone knows the answer to this question , let me know.

If you are not on the account then yes, it would be unethical and illegal and could get you into big trouble if he pursues it.

In addition to what Emland has stated, I very much doubt that they would give you a loan against an account that is not in your name and you are not a signer on.

Yes it is illegal, so your divorce takes a few more months ? Or you perhaps go to a temp agency and get a job for the summer, go to McDonalds ? Deliver news papers ?

Yes it would be illegal and could possibly be construed in court as identity theft. Many identity thefts are family related.
