I assume you received a telephone call from a Medical Review Officer (MRO) during the drug test?

There are two parts to your question. 1) The test itself, and 2) the employer's written policy (a requirement) in relation to a positive test.

Providing that the test was performed in accordance with DOT regs the answer to your question lies in the employer policy. Action against you must be clearly defined therein and applicable to all those similarly situated. There is little left to chance or choice in DOT regs and all information must be made available to you.

Given the circumstances you describe I would recommend that you review employer responsibilities under the federal guidelines. Those are contained in 49 CFR Part 40 available on-line at: DOT - TITLE 49: TRANSPORTATION Of interest to you would be, but not limited to, Section § 40.23 What actions do employers take after receiving verified test results?

If you have any further questions after reviewing this information just check back.
