On November 22,2011 they came to our house with a search warrant to search our house for stolen electronic because a boy said my little brother which is 17 was with him when he broke into someone apartment . All this happen 3 weeks after the young man was in the YDC. So they took all of our television, DVD players, laptop,games, and PS3. I gave them the receipts I had brought and the ones we could get they still had on file. They returned some and still have some. The charged him with 3 counts of burglary and manufacturing marajiauna. He had a bond hearing they didn't give him a bond. And it's now February he still in jail without a court date.

He has been indicted, at his first appearance he was changed, charges were read and he had the ability to plead. ( this normally happens the morning after arrested) in some Georgia Counties it happens over video from the jail.

Next I find it hard to believe they did not give him a bond, that does not sound right, they may have gave him a large one, But it can take from one year to 18 months often to get to trial.

Good question is he in jail or YDC. Youth court works totally different than adult court.

No they just read him his charges. No they didn't give him no bond not even a high one. He suppose to go to court on the 29th. They say for arrangement.

That is what happens in GA, he appears the next morning normally after being arrested, the read the charges and he is asked to plead. The judge reviews and they see if there is enough evidence to continue. What outstanding motions are there to be heard at the next hearing.

Again, if he is being charged as a youth the entire system is different.

He is in the jail not the YDC. They didn't get any picture nor they didn't find anything they were looking from, but they found something that someone sold to him. Should they charge him with receiving stolen property instead of burglary? I moved in with my mom them in August and my niece had her television in their house. Because she was moving so she asked can she put some of her stuff in her house for she won't haveto rent a storage unit. My mom them told her yes. So when they came with the search warrant and took everything they found that her TV was stolen and charge me with receiving stolen property because I was sleeping in the room where the TV was. So that's why I feel like he should've been charge with the samething. They don't have proof he broke into someone house .

So they also charged you with receiving stolen property? It appears that they know the property they found was stolen, but are not sure who took it. So they are charging both of you and will sort it out when they get to it.

It appears that they took you son (Brandon?) into custody because, in addition to the theft-related charges, they have evidence that he is guilty of some drug charges as well.

As Excon told you, he needs an attorney to be lookng into this. If he hasn't been assigned a public defender yet, contact your local public defender's office and see what they can tell you. If you also are being charged, you should have an attorney too (a different one). Has one been assigned to you yet?

They have 72 hours to CHARGE you, but unlimited time to indict you. They don't need an indictment.
