Well first I dont fully understand... you said it connects but when you speak it doesnt go through... for this check your volume levels... maybe you have the headset muted, this would be part of the in-game options.

But then you also said that when you try and connect it you get an error message. Can you type exactly the message you get (like the error code) and maybe i can help more.

Fianlly, even if you dont have the receipt Best Buy should exchange it for another headset. Is this the "official" PS3 bluetooth headset?

I found this on boards.playstation.com about this exact problem... hope it helps

A Bluetooth headset has to be registered, or "paired", with your PS3 before it can be used.

Make sure your Bluetooth headset is fully charged before you begin.
Check your headset instructions for entering "pairing mode". Activate your headsets' "pairing mode" so it can be recognized by the PS3.
On the Cross Media Bar (or XMB) of the PS3 go to the "Settings" tab, then down into "Accessory Settings", then down into "Manage Bluetooth Devices".
With your headset in pairing mode, follow the onscreen instructions and let the PS3 scan for your headset. When your headset is found, follow the prompts and enter a pass key (if necessary- the default is usually 0000 for all brands). The pairing should now be complete.

lol i know you said the problem was fixed but i have to comment. the headset i got which isnt intended for ps3 is for a phone and the problem i had is the same one you had so you probably did the same. i got so frustrated i about broke it in half. all i did was unsync it and then sync it back and wall-a there it was working again. sometimes to many bluetooth items linking here and there such bluetooth items as cell phones and other headsets etc. good gaming and good shooting
