Tax status

Hello,

Quick question - Came to US for official work on Nov 24 on B1 status and will be in the US until apr end. I was also in US for a 1 week in May
I also got married to a person who has a H1 visa and is working in the US since the last 4 years on 7th Nov. The question we have is - can my husband now file taxes as married filed jointly by showing me as his spouse.(i just have a B1 visa)
Also i am still on my home country salary and just get a small amt as exps while in US.

advise

Kind Rgds,
Harsha

You can file resident tax return as Married Filing Jointly.

You must both declare your worldwide income for 2007.

You will complete forms W7 (application for ITIN) and attach with your tax return.

If you decide to file as Married Filing Jointly as First Year Choice, you must attach a statement signed by both of you to your return stating that you qualify to file as residents as First Year Choice and that you EXPLICITLY CHOOSE to file this way.
