Student on F1 visa, then OPT and now a H1B visa

Hi,

In 2007, I was on F-1 visa until May, then started working on OPT until October 1st when my status changed to H1B finally! I never left the country in 2007 or 2006 but was out of the country for 1 month in 2005.

Based on this information, do I have to file the 2007 taxes as 1040A or 1040NR? I am confused about being counted as a Non-resident alien or Resident Alien... Also, can I still claim the Article 21C deduction.. (The treaty for Students coming from countries like India..)..

Form 1040NR or 1040NR-EZ PLUS Form 8843.

Yes, you can claim the standard deduction as an Indian student.

For 2008 you will file resident tax return if you stay on H1-B.
