stimulus tax rebate checks

Will non-resident aliens with H-1B visas get the currently discussed tax rebate checks as well that the government is going to send to taxpayer to stimulate the economy? I have been in the States for the last 4 working etc.

I am rather confident that resident aliens will get the tax rebate for whatever amount that their income allows.

Non-resident aliens? That's another story.

Remember that is is NOT YET LAW! It has to be passed by both houses of Congress and signed by the President.

I checked the law. It is clear that "nonresident alien individual" do not qualify for the rebate.
Based on the Definition on IRS form W-8BEN:
"Any individual who is not a citizen or resident of the United States is a nonresident alien individual. An alien individual meeting either the "green card test" or the "substantial presence test" for the calendar year is a resident alien. Any person not meeting either test is a nonresident alien individual"

So if you filed 1040NR (or 1040NREZ) form, you'll be receiving a nice letter form IRS saying that you don't qualify for this rebate. This happened in the 2001 rebate.

My guess, based on IRS definition, if you are considered a resident alien for tax purposes (either Green Card or subtantial test) and you filed either 1040 or 1040EZ form, you'll most probably will be receiving the check.

From IRS site
"Taxpayers must have valid Social Security Numbers to qualify for the stimulus payment. If married filing jointly, both taxpayers must have a valid Social Security Number. And, children must have valid Social Security Numbers to be eligible as qualifying children.

Taxpayers who file their tax returns using an Individual Taxpayer Identification Number issued by the IRS or any number issued by the IRS are ineligible. Also ineligible are individuals who can be claimed as dependents on someone else’s return, or taxpayers who file Form 1040-NR, 1040-PR or 1040-SS."

Also to get rebate check you must file your 2007 tax return. You must have minimum of $3,000 of eligible income (does not include interest, capital gains,..). check this link:
