    Spouse ITIN application rejected
    Hi,

    I had filed 1040 as Married Filing Jointly along with a W-7 ITIN application for my wife. I received a notice today from IRS saying that they have rejected the application. The reason given is: The supporting documentation is expired. IRS has also advised me to file a new W-7 along with a copy of the tax return, with the word "copy" written in the top margin of the tax return.

    I had sent my wife's Original US driver license and Original Indian Voter's ID card, which is equivalent to a National ID card. While the US driver license had an expiration date, the Voter's ID card had no expiration date so I assumed that I could send it. However, apparently IRS has not accepted it. IRS has not sent me back these originals and I will try to follow up with them regarding this.

    I am now confused regarding the status of my 1040 form. I would greatly appreciate if someone here could help me.

    1. How is IRS going to handle my 1040 tax return from this point onwards? Is it going to wait until I send the new W-7 or is it going to process the tax return as is?
    2. I might not be able to get the supporting documentation for W-7 ready by October 15th, which is the deadline for filing. What will happen if I am only able to send the new W-7 after Oct 15th?

    Generally, the IRS will wait a set period for the new Form W-7. If they get the new W-7 with adequate ID, they then process the return.

    If not, they process the return without the dependency exemption.

    You need to call the IRS and get guidance.

    Just as a note:
    It's not recommended to send original documents to the IRS. They are known to lose them.
    Although it seems easier to send originals, you should get certified copies and use those. A certified copy of her passport can serve as a standalone document. You need to get the copy certified by your/her government, he simple notarized copy is not enough.
    Also, your wife can't drive until she get's her original license back, another reason not to send the original.

    Unfortunately, I just saw this blog entry.

    I had also sent India voter ID for IRS W7 ITIN application for my spouse. So my spouse's application has been rejected saying voter ID is expired. So please don't use India Voter ID as a proof document.

    For now I have sent additional documents to prove her identity that conform to IRS requirements. My concern is what will happen to the tax return filed with the first ITIN application. Will it be processed before ITIN is processed? To set the timelines:

    I filed the first return + ITIN application on March 8.
    It reached IRS on March 15.
    I got a notice saying ITIN has been rejected on April 6, with date April 2.
    I submitted another ITIN application which should reach on April 13th/April 15th.

    Hi

    The same case happened with my wife. Her ITIN application is rejected and I don't know now in what status they have filed my Fed returns. Also, I need to file my state returns which I can not do without her ITIN. Did u get your returns? Are they the same amount? Also, can you tell me what documents did u send second time? Did you receive the originals you sent earlier.

    Usually, the IRS will HOLD the tax return for a set period (30 days) waiting for the re-submission of the new W-7 with correct validation documentation.

    It might be best for your wife to go to a tax assistance center to have them certify the actual passport without having to send in the passport.
