    Someone ever claimed your child on taxes illegally?
    I am very mad someone is claiming my 3 year old son on their taxes... not sure who or what I should do>>>>>>>>>:mad::mad:

    Call the IRS at 1-800-829-1040
    I don't believe that they will specifically be able to tell you who is doing it but they can definitely tell you what to do in order to correct it. Hope this helps.

    If you believe you are rightfully entitled to claim your son as your dependent, then file that way. You will probably find that you can't file electronically, as the IRS computers will recognize that your son's SS number is already reported on someone else's return, and automatically reject your return. So you will have a paper return, the old fashioned way. The IRS will notice the conflict and investigate. Usually this kind of thing happens when a couple splits up or divorces, and both parents try to claim the child. If that's what's happening here - I recommend you include a note in your return stating that you are the rightful clamaint, either because you have physical custody of the child or because you have a court decree that specifically grants you the right to do so.

    I am going through something similar although I know who it is. It is my 3 year old daughters father. He believes he is entitled to claiming her every other year, even though there is no waiver signed stating he has this right. He actually did this last year and we both claimed her. I was told to claim her anyway and they would ivestigate the mistake but from my personal experience, nothing was done. He got the stimulus check as well as the normal expemtion. So... I would suggest doing two things. Claim him anyway and also call the number. That way you did your part on claiming him and when you call, they have personalized your problem and I would assume they may catch the problem sooner. Hope it gets worked out for you!

    Assuming you are divorced, is the exemption issue addressed in your divorce decree? If you do not know, you MAY want to check on that, because a divorce decree is a legal document that the IRS MUST abide by.

    You don't know that for sure. The IRS moves slowly. They may not have caught up with it yet.
