Social Security & Medicare Taxes Withheld Wrongly

Hi,

I have a question about getting the refund for Soc Sec & Medicare Taxes which was wrongly withheld.

I joined my company in Apr 2006 when I was in OPT and I converted my F1 to H1 in Oct 2006. My company or myself wasn't aware that employees who were in OPT were exempt from paying these two taxes. Just a few weeks back, I came to know that I can get the refunds from the IRS since my company refused to refund the amount since its not there fault.

So, could I file for a refund even though its been a long time or is there any time frame that I should I have filed my refund because in one of the related questions in askmehelpdesk.com I read an answer from the tax experts that the exempt taxes should have been claimed before Apr 15th, 2007.

Please help me. I greatly appreciate your reply. Thanks!

You have plenty of time. The absolute deadline for claiming the refund using Form 843 is 18 April 2010, the third anniversary of the normal income tax filing deadline for 2006.
