    Is filing 1040 OK for F1 students
    Hello,

    I have been going through this forum and have discovered that I may not be using the right tax forms. I filed my 2003 and 2004 tax returns using Turbo Tax. I have been in the USA for over 300 days in each of the 3 years from 2003-2005.

    In 2003, I was on F1 Visa throughout the year and I filed 1040A (with itemized deduction) and Form 8863. I received refund for 2003.

    In 2004, I was on F1 Visa throughout the year; but I also did a summer internship for 3 months on my CPT. I filed 1040A but did not have any itemized deductions. I received a refund for 2004.

    Now, for 2005, I have been on F1 Visa; but also had a 5 month internship on my CPT. Turbo Tax is prompting me to file a 1040EZ.

    Is the above OK? Do I need to file 1040NR-EZ or 1040NR this year? Do I need to file amendments for the last two years?

    Technically, you should file as a non-resident alien, filing Form 1040NR or 1040NR-EZ. You should also amend your 2003 and 2004 return, attaching Form 1040NR or 1040NR-EZ. No additional tax will be due.
