    Opt to h1b Taxes
    Hi Experts,

    I have a few questions regarding taxes. I was in OPT from October 2006 through September 2007. I am currently in H1B status from October 2007 till present. MY F1 Visa is valid from Nov 2003 to 2008.

    I have only one W2 for 2007 from my employer. They did not deduct my Social Security and Medicare from my pay during my OPT, but did so as soon as my H1B status kicked in from October 1st last year.

    How do I pay my taxes?

    Which forms to use?

    Should I file under a resident or non-resident status?

    And any other detailed information would be very helpful.

    You are still non-resident since OPT is actually F1 status, and you do not meet the substantial presence test (only 3 months in H status). You can use forms 1040NR or 1040NR-EZ if you made less than 100,000 and your situation is simple.

    Your taxes should mostly be already "payed" by your employer's withholding. If the W-4 you filled in with them is correct, you should get a little refund.
