    Missing W2's
    Hi All,

    Here is my situation. I was working in US from Feb 2001 to April 2005 on L1B. I have got the W2s of years 2001, 2002 and 2003. My two W2's of year 2004 and 2005 are missing. I have sent two mails to my previous employer (for which I was working while in US) to sent my W2's, but seems to be they are not interested on responding ex. Employees. I want to file returns for year 2004 and 2005, can anyone please guide me how I can do that. I have got all pay stubs of all months. Currently I'm in India and may visit states during summer.

    Any help would be greatly appreciated.

    Hi,
    If you have tried to obtain your W2's and can't, you can file taxes without them. Here is some more information:
    "If a taxpayer cannot obtain the documents after attempting to contact the employer, the IRS says the taxpayer should file Form 4852. Form 4852 is the substitute for Form W-2. It is called "Substitute for Form W-2, Wage and Tax Statement, or Form 1099-R, Distributions From Pensions, Annuities, Retirement or Profit-Sharing Plans, IRAs, Insurance contracts, etc."

    Since you have all your back pay stubs, you can make copies of them, to submit.

    I agree with FredG. You can and should file your return with the paystub from the last payperiod of each year in question.

    I have done so for numerous clients in the past, and the IRS will honor the return with the paystub if the paystub comes close to the data they have on file.
