    Regarding resident alien filing status
    Hello,

I am on H-1B visa since October 2012 and do satisfy the substantial presence test for 2013.

I have a couple of questions:

    1) This is a rather dumb one, but I got my H-1B visa stamped on the passport only in December 2013, so, does this change my eligibility as a resident alien?

    2) Assuming NO is the answer to (1), can I use a tax software like TurboTax to file my federal taxes or is there any caveat to using it?

    Thanks.

The date that matters is the EFFECTIVE date of the H-1B, which I assume is 1 October 2012. The stamping date is irrelevant for tax purposes.

So, yes, you can file using TurboTax with no problem.
