Nevada taxes married to someone in California
I live and work in Nevada and am getting married to a man who lives and works in California (30 minutes away). I will continue to live and work in Nevada, but will come up to our shared rental house in California on the weekends. How should we file and is it acceptable to be married, but reside in separate states? The reason I am hesitant to switch to California is that I do indeed work and rent a house in Nevada and I don't want to pay state taxes in California if I am still residing more than part time in California.

Any income earned while living and working in Nevada is Nevada income. CA may still come after you. You may have to provide a letter from employer that you work in Nevada, and proof that you live in Nevada.

You should be able to claim Nevada residency for at least a few years.

But, eventually, the state of California will attempt to claim that you are a California resident.

As this appears to be the most recent question on this sort of topic, I thought I would ask my question here too. (Sorry if it appears that I'm stealing the thread).

    My situation is as follows:
    We live in MI.
The office my paycheck comes from is in OH.
The client site I work at is in MI.
We have never actually been to the office in OH.
I know we will pay tax in MI, but would we pay tax in OH?

    Thanks for your time.

Hello hundredweight. You should NOT tag your new question on top of an old thread, but rather should start a new thread. But to answer your question - since you do not live in OH, nor work in OH, OH has absolutely no standing for collecting income tax from you. I trust that your employer is NOT withholding OH tax from your paycheck - right?

    ebaines,
Thanks for the reply. I won't be stealing threads again. Sorry.

As for my tax situation, I have not yet received a paycheck as I have only just started. But someone at the office mentioned that she was taxed in two states, so I thought I'd try and find out what my situation would be.

    Thanks again.

If you neither worked nor lived in Ohion, then Ohio has NO LEGAL STANDING to tax your salary.

Just make sure your employer knows this and withholds ONLY Michigan state taxes.
